Terms and Conditions
In the following terms and conditions, “we” and “our” can refer to either ‘Flamecrusher 2006 Ltd.’ or ‘Bernard Gillon Motorsport Ltd.’
We reserve the right to alter these Terms and Conditions at any time, without notice. Even if you have read them previously, they may have changed since then, and it is your responsibility to make sure that you understand the current terms and conditions.
PRICING:
All prices shown on the website are in New Zealand Dollars and, unless otherwise stated, include GST (except on the freight costs page. All freight prices exclude GST). We reserve the right to alter prices without notice; this will not affect any orders that have already been paid for.
All pricing does not include delivery. Delivery costs are added when you check out your shopping cart. Extra costs apply for rural deliveries, Saturday deliveries, and large or heavy objects.
AVAILABILITY:
We make every effort to keep our website catalogue up to date; however, some of our products may be out of stock. If this is the case we will contact you when we receive your order to advise you of an expected arrival date, and to confirm whether you wish to continue with your purchase. If not, we will immediately provide a full refund of the goods that you no longer wish to purchase.
We can not guarantee that products will be the same as the ones pictured on the website. Colours/brands may (very rarely) vary due to availability.
We endeavour to make all made-to-order race suits within three weeks of receiving confirmation of design, colour, measurements and embroidery details of your suit. If we are unable to meet this deadline for any reason we will contact you.
DELIVERY:
We do our best to send all products within one working day of receiving payment for your order, unless you are otherwise notified. Delivery is usually overnight, however please allow up to 4 working days for your goods to be delivered. If you are concerned as to the whereabouts of your purchases, feel free to contact us and we will track them down.
Shipping to international addresses can be arranged by contacting us.
We only deliver to physical addresses; no PO Boxes please.
PURCHASING PRODUCTS PRICED AT $0.00 ONLINE:
Some products (including, but not limited to, Embroidery and Custom Designed Suits) can be checked out on our shopping cart at a price of $0.00. Doing so does not constitute a purchase, merely an indicator of your desire to purchase these products. Once a price has been confirmed, we will advise you of the agreed price, and your payment can then be processed. All other terms and conditions still apply to these purchases.
PAYMENTS/SECURITY:
Credit Card Payments are processed through Payment Express (developed by Direct Payment Solutions Limited). You will be taken to a secure page on their site to complete the transaction, after which you will be returned to our website. This means that we neither see nor store your credit card details. DPS are a reputed company (certified with banks in New Zealand, Australia, Pacific Islands, Singapore, South Africa, USA and United Kingdom) and you can be confident of your online safety.
Alternatively, you can pay by Direct Credit, by going to your online banking account and making a payment to the bank account details provided on your invoice. Please ensure that your order number is used as a reference.
You can also pay by cheque. Please make cheques payable to “Bernard Gillon Motorsport Limited” and post to “Flamecrusher, PO Box 14335, Tauranga”. Please ensure that your order number is written on the back of the cheque.
Orders that have been paid for by cheque or direct credit will only be shipped once the payment has been cleared. This may take a few days.
REFUNDS/RETURNS POLICY:
We do not exchange or refund products if you change your mind, so please choose carefully. We will, however, refund, replace or exchange faulty goods. Replacement items are subject to availability; we will notify you if we don’t have that particular item stocked and keep you informed as to when it will arrive, or we can provide a refund if you should prefer. Please notify us of faulty goods within 48 hours of receiving the delivery, and return the faulty goods to us within 7 days of delivery with original packaging, and in an unused condition. Goods can be returned to 6A Hynds Road, Greerton, Tauranga.
PRIVACY:
Flamecrusher respects the privacy of all our customers. We will not sell or pass on any information regarding to any person or organisation. Your personal information is encrypted and stored on our secure servers to assist with placing future orders. If you would like this information altered or removed, you can either do it by logging on to our website, or by sending us an email.
We (infrequently) send out a newsletter to those who have opted to receive it. If you would like to unsubscribe from a newsletter, this can also be done by logging on to the website or by sending us an email
We reserve the right to refuse to make a sale, or to cancel a sale that has already been processed, or to in any way not proceed with a sale, for any reason whatsoever. No correspondence will be entered into about such a decision made by us or any of our staff.
10% DISCOUNT OFFER:
This 10% discount offer applies to the normal retail price of goods. It can't be combined with any other offer. It is only available for new purchases that are made (and completed) online from the 16th of April. Any purchases made before this date are not included in the offer. Alterations/repairs are not included, as they can't be purchased online. Freight is not included in this discount. This offer is not available for sales made at our retail store or for phone orders. If a refund is necessary due to faulty goods, we will refund the discounted amount that you paid, not the normal retail price. This offer is only available until the 14th of May, however it may be extended or shortened without notice. This offer is only valid if the customer types the code that they were given into the "discount code" box in the shopping cart. If a customer forgets to type the code in and completes the purchase, we are unfortunately unable to reverse the process in order to give you the discount, and we can't refund you the discount. So please remember to type the discount code in.
"IF YOU WANT IT, WE'LL GET IT" CLAIM:
Obviously, this claim only relates to motorsport parts. If you want, say, an elephant, you will regrettably have to look somewhere else. This claim has some exclusions: if we are unable to track down such a part we won't be able to get it for you. Believe me, we will try our hardest to find it, but if it so happens that we are unable to find it, then unfortunately we can't "get it" for you. Also, there may be some things that we can't bring into New Zealand because of various laws or regulations. And, as selfish as it may seem, we reserve the right to refuse to find any product/good/service for any reason whatsoever. No argument will be entered into. That said, we will try to find your part for you, because we like happy customers.

Whilst the safety products that we sell are, to the best of our knowledge, designed to increase driver safety, we can not be held accountable for any injury or damage to any person or property, whatsoever. Our products are sold without warranty or representation to the product’s ability to protect the user from injury or death. The user assumes that risk.
